User Agreement
SUBJECT MATTER OF THE AGREEMENT
1.1. The subject matter of this Agreement is the provision by the Service, at the request of the User, of a complex of video communication services for communicating with other users on the Service's website.
1.2. The Agreement is a public offer in accordance with Articles 633 and 641 of the Civil Code of Ukraine and is the equivalent of an "oral agreement" and has proper legal force.
1.3. By using the Service's services, the User agrees that:
a) he/she has familiarized himself/herself with the terms of this Agreement and the Service's Rules in full before receiving services from the Service.
b) this Agreement, in accordance with Articles 633 and 641 of the Civil Code of Ukraine, is an offer, and the User's application for the provision of services, sent to the Service in any way and in any form, including payment for a package of services, means that the User accepts all the terms of this Agreement in full without any exceptions or limitations on the part of the User (acceptance). This Agreement, concluded by accepting this offer, does not require bilateral signing and is valid in electronic form.
c) if the User does not agree with the terms of this Agreement or does not have the right to conclude it under the law, he/she should not start or immediately stop using the Service's services.
1.4. The relations of the Parties may be additionally regulated by separate documents and agreements, including those regulating the use of additional or personal services. The application of such additional documents and agreements does not cancel the effect of this Agreement.
INFORMATION ABOUT SERVICES
2.1. In accordance with this Agreement, the Service provides the User with the following services:
2.1.1. Automatic search for other users on the Service who meet the criteria specified by the User;
2.1.2. Provision of video communication with any other user selected by the User.
2.1.3. The cost of the Service: VIP subscription for 1 week - 200 UAH, for 1 month - 600 UAH/month and subscription for 3 months - 1000 UAH.
COST AND PAYMENT TERMS OF SERVICES
3.1. To begin using the Services, the User agrees to:
complete the registration form;
select and pay for the desired service package.
3.2. The Service provides services solely on the basis of prepayment by the User upon conclusion of the Contract.
3.3. The amount payable for the Service depends on the service package selected by the User.
3.4. Payment for the Services is made by the User in hryvnia or dollars in automatic mode through payment systems on the Service's website.
3.5. In case of receiving payment for the Services not in full, the Service automatically suspends further provision of the Services until full payment is received.
PROCEDURE FOR CONCLUDING THE CONTRACT AND PROVIDING SERVICES
4.1. Provision of the Service will begin automatically upon receipt of payment to the account or other details of the Service.
The contract is concluded by the User's acceptance of the Offer.
The Offer may be accepted by the User by transferring funds to the Service's details specified in this Agreement.
4.2. The User's actions specified in clause 4.1 of the Offer are considered as acceptance of the Offer.
4.3. The date of acceptance of the Offer and, accordingly, the date of conclusion of the Contract is the date of receipt of funds from the User to the settlement account or other details of the Service.
4.8. The Service guarantees the User high-quality video communication with the selected User(s).
4.9. Services are considered rendered:
if the Client has used the Service and the video communication services provided to him/her.
CONFIDENTIALITY
5.1. The User undertakes not to disclose to any third party any data of other users. The Service guarantees the confidentiality of the information provided by the User during registration or when placing an order.
5.2. The Service guarantees that the User's personal data will not be used for selfish purposes, on third-party resources or for spamming, will not be transferred without his consent or notification to other users or third parties, and also guarantees compliance with other requirements of the Law of Ukraine dated 01.06.2010 No. 2297-VI "On Protection of Personal Data".
5.3. By registering, the User agrees to the processing of his personal data stored in the Service's database solely for the purpose of identifying the User on the Service's website.
DURATION OF THE AGREEMENT. PROCEDURE FOR MAKING AMENDMENTS
6.1. The User's acceptance of the Offer confirms the conclusion of the Agreement on the terms of the Offer.
6.2. The Agreement comes into force from the moment of payment for the services by the User and is valid until the Service fulfills its obligations under this Agreement.
6.3. The Service has the right to make changes to the text of this Agreement at its discretion at any time and without prior notice to the User. The current (valid) version of the Agreement is always available on the Service's website.
6.4. The User agrees and acknowledges that making changes to the Offer entails making these changes to the already concluded Agreement between the User and the Service; changes to the Agreement come into force with such changes in the Offer.
FORCE MAJEURE
7.1. The Parties shall not be liable for the complete or partial non-performance of obligations under this Agreement if such non-performance is due to force majeure circumstances. Such circumstances include natural disasters (fires, floods, earthquakes, etc.), military actions or government decisions, unlawful actions of third parties, and other circumstances beyond the control of the Parties.
7.2. The Party referring to force majeure circumstances must notify the other Party by email within 3 calendar days of the occurrence of such circumstances, and upon the request of the other party provide notarized copies of documents confirming the occurrence of force majeure circumstances.
OTHER CONDITIONS
8.1. The Performer reserves the right in accordance with Article 6 of the Law of Ukraine "On the Protection of Personal Data" to collect and process personal data - any action (operation) or combination of actions (operations) carried out using automation tools or without such tools with personal data, including collection, recording, systematization, accumulation, storage, refinement (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
The list of personal data for processing, which is given consent: surname, name, patronymic; date of birth; place of residence, email address, as well as other data specified in the website form. The Client accepts the condition of collection and processing of personal data and gives consent to the processing of data from the moment of acceptance and reading of this agreement. Consent to the processing of personal data is valid indefinitely from the moment of acceptance and reading of this agreement.
8.2. The Service provides default messaging in messengers and by email. The Client may unsubscribe from receiving messages at any time by indicating this in the received email and clicking on the "Unsubscribe" link, or by setting restrictions in the personal account.
8.3. If any provision of this Agreement proves to be unenforceable, it shall be interpreted in accordance with the current legislation of Ukraine, taking into account the original interests of the Parties, while the remaining provisions shall continue to be fully effective.
